What are the basic requirements to apply for the UK spouse and marriage settlement visa?
  • The sponsor must be a British National or settled with Indefinite Leave to Remain in the UK.
  • You must have a legally registered marriage / civil partnership in your country of residence or have lived together with your partner for a minimum and continuous period of 2 years.
  • If you intend to apply as a fiance/fiancee you must demonstrate that you intend to register a marriage with your partner in the UK within 6 months of entry.
  • You must demonstrate that you are able to support yourselves financially in the UK without any recourse to public funds.
  • Your sponsor must demonstrate that they satisfy the minimum income threshold of a gross annual income of £18,600. To also sponsor children in the application, the financial requirements will increase £3,800 for the first child and an additional £2,400 for each child thereafter.
  • The applicant must pass an English Language Exam approved by the Home Office for the purposes of entry clearance in this category which demonstrates sufficient knowledge of the English Language.
  • The sponsor must have a dwelling place to accommodate his/her spouse and children in the UK without any risk of overcrowding.

What benefits are associated with the spouse visa?

The successful applicant will be eligible to work, study and avail medical services in the UK on a spouse visa. They will also be entitled to travel freely to and from the UK.

For how long a spouse visa is issued initially?

If applying from overseas, the spouse visa is issued initially for a period of 30 days to enable you to travel to the UK and collect your Biometric Residence Permit (BRP) card. The BRP card itself is valid for an initial period of 33 months. If you apply from within the UK or to extend the initial visa, the BRP card will be granted for a period of 30 months. Applicants who are already in the UK can also switch to a spouse visa.

How can I extend my spouse visa?

You can apply to extend a spouse visa from inside of the UK for an additional period of 30 months. During the processing of the visa, you are entitled to continue working and living in the UK as per your visa conditions.

At the completion of this period, the applicant becomes eligible for Indefinite Leave to Remain (ILR) in the UK. Once the applicant is granted ILR, they are eligible to apply for a British citizenship via Naturalisation.

What is the processing time for a spouse visa?

If you are applying from overseas, there is no fixed visa processing time provided by the UKVI however on average an application is decided within 12 weeks. If applying inside the UK, the Home Office’s standard published processing times is up to six months for an application to be decided. If for any reason your application will take longer, you will be contacted to be made aware of the reasons.
