The successful applicant will be eligible to work, study and avail medical services in the UK on a spouse visa. They will also be entitled to travel freely to and from the UK.
If applying from overseas, the spouse visa is issued initially for a period of 30 days to enable you to travel to the UK and collect your Biometric Residence Permit (BRP) card. The BRP card itself is valid for an initial period of 33 months. If you apply from within the UK or to extend the initial visa, the BRP card will be granted for a period of 30 months. Applicants who are already in the UK can also switch to a spouse visa.
You can apply to extend a spouse visa from inside of the UK for an additional period of 30 months. During the processing of the visa, you are entitled to continue working and living in the UK as per your visa conditions.
At the completion of this period, the applicant becomes eligible for Indefinite Leave to Remain (ILR) in the UK. Once the applicant is granted ILR, they are eligible to apply for a British citizenship via Naturalisation.
If you are applying from overseas, there is no fixed visa processing time provided by the UKVI however on average an application is decided within 12 weeks. If applying inside the UK, the Home Office’s standard published processing times is up to six months for an application to be decided. If for any reason your application will take longer, you will be contacted to be made aware of the reasons.
